Good Shepherd is a livestock management service operated by Offgrid Engineering (Pty) Ltd ("we", "us", "our"), a company incorporated in South Africa. For the purposes of the Protection of Personal Information Act 4 of 2013 (POPIA), Offgrid Engineering (Pty) Ltd is the responsible party.

2. What Personal Information We Collect

We collect the following categories of personal information:

• Identity information: name and surname
• Contact information: email address, phone number
• Account information: login credentials, organisation name, subscription tier
• Financial information: subscription billing records. Card details are processed and held by PayFast — we do not store them.
• Usage data: feature interactions, log data, device and browser type, IP address
• Farm and livestock data: animal records, health events, breeding records, and other farm management data you enter into the service

3. Why We Collect Your Information

We process your personal information for the following purposes:

• To create and manage your account
• To provide, operate, and improve the Good Shepherd service
• To process subscription payments via PayFast
• To send service-related communications (receipts, notifications, product updates)
• To respond to your support queries
• To comply with legal obligations
• To detect and prevent fraud and misuse of the service

We will not use your personal information for any purpose incompatible with those stated above without your consent.

4. Legal Basis for Processing

We process your personal information on the following grounds under POPIA:

• Contract performance: to deliver the services you have subscribed to
• Legal obligation: to comply with applicable South African law
• Legitimate interest: to improve our services, ensure security, and prevent fraud
• Consent: where you have given us explicit consent (e.g. marketing communications)

5. How We Share Your Information

We do not sell your personal information. We may share it with:

• PayFast (Pty) Ltd: to process subscription and store payments. PayFast is subject to its own privacy policy.
• Google LLC (Firebase): we use Firebase services (Firestore database, Authentication, Cloud Functions, Cloud Storage, and Cloud Messaging) to store and operate the service. Firebase is operated by Google LLC.
• Law enforcement or regulators: where required by applicable law or court order.

We require all third-party processors to handle your personal information securely and in accordance with applicable law.

6. Cross-Border Transfer of Information

Google Firebase operates servers located outside South Africa, primarily in the United States. By using Good Shepherd, you acknowledge that your personal information may be transferred to and processed in countries outside South Africa. We take reasonable steps to ensure such transfers are subject to appropriate safeguards.

7. Data Retention

We retain your personal information for as long as your account is active and for a reasonable period thereafter to comply with legal obligations, resolve disputes, and enforce our agreements. Farm and livestock data you enter belongs to you and may be deleted on request. When an account is permanently deleted, personal information is removed within 90 days, subject to any legal retention obligations.

8. Data Security

We implement industry-standard security measures including encryption in transit (HTTPS/TLS) and at rest, access controls, and regular security reviews. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

9. Your Rights Under POPIA

As a data subject, you have the right to:

• Access: request a copy of the personal information we hold about you
• Correction: request that inaccurate or incomplete information be corrected
• Deletion: request that your personal information be deleted, subject to legal retention requirements
• Objection: object to the processing of your personal information in certain circumstances
• Complaint: lodge a complaint with the Information Regulator of South Africa

11. Cookies and Local Storage

Our website (gsfarm.co.za) uses browser local storage solely to maintain your shopping cart between page visits. We do not use third-party tracking cookies on this website. The app at app.gsfarm.co.za uses session cookies necessary for authentication and service functionality.

12. Children's Privacy

Good Shepherd is not directed at persons under the age of 18. We do not knowingly collect personal information from minors. If you believe a minor has provided us with personal information, please contact us and we will delete it promptly.

13. Changes to This Policy

We may update this policy from time to time. We will notify you of material changes by email and by updating the "Last Updated" date above. Continued use of the service after notification constitutes acceptance of the updated policy.

1. Acceptance of Terms

By creating an account or using the Good Shepherd service (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and Offgrid Engineering (Pty) Ltd ("we", "us", "our").

2. The Service

Good Shepherd is a cloud-based livestock management platform accessible at app.gsfarm.co.za. It allows farmers to record, track, and manage livestock data including animal records, health events, breeding programmes, weight tracking, and farm analytics.

3. Account Registration

To use the Service, you must create an account. You are responsible for:

• Providing accurate and up-to-date registration information
• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorised access at info@gsfarm.co.za

You must be at least 18 years old to register an account.

4. Subscriptions and Payments

Certain features require a paid subscription. By subscribing:

• You authorise recurring monthly charges to your payment method via PayFast
• Subscriptions auto-renew each month until cancelled
• You may cancel at any time through Settings → Subscription Management
• Our full Refund Policy applies to all subscription payments

Prices are displayed in South African Rand (ZAR) and are inclusive of VAT where applicable.

5. Store Purchases

Hardware and accessory purchases through the GS Farm store are subject to order terms confirmed at checkout. Payments are processed via PayFast in ZAR. Delivery and return conditions are communicated at the time of purchase.

6. Your Data

You retain full ownership of the farm and livestock data you enter into the Service. We do not claim any rights over your data. We process it solely to provide the Service as described in our Privacy Policy. You may export or request deletion of your data at any time by contacting info@gsfarm.co.za.

7. Intellectual Property

The Service, including its software, design, trademarks, and content, is owned by Offgrid Engineering (Pty) Ltd and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for your own farming operations. You may not copy, modify, distribute, reverse-engineer, or create derivative works from any part of the Service.

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorised access to any part of the Service or its infrastructure
• Upload malicious code, viruses, or harmful content
• Resell, sublicense, or otherwise commercialise the Service without prior written permission
• Impersonate any person or entity

We reserve the right to suspend or terminate accounts that violate these rules.

9. Service Availability and Disclaimer of Warranties

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose or merchantability, to the maximum extent permitted by South African law.

10. Limitation of Liability

IMPORTANT NOTICE (Consumer Protection Act, 2008 — Section 49): The following clause limits your legal rights and our liability. Please read it carefully before using the Service.

To the maximum extent permitted by the Consumer Protection Act 68 of 2008 and other applicable South African law:

• Offgrid Engineering (Pty) Ltd's total liability to you for any claim arising from use of the Service is limited to the total subscription fees you paid in the 3 months immediately preceding the claim.
• We are not liable for any indirect, incidental, consequential, or special damages, including loss of livestock data, loss of profits, or business interruption.

Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be lawfully excluded.

11. Account Termination

We may suspend or terminate your account if you materially breach these Terms, fail to pay subscription fees after reasonable notice, or if we discontinue the Service. You may close your account at any time. On termination, your access to the Service ends and your data will be handled in accordance with our Privacy Policy.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email with at least 20 days' notice. Continued use of the Service after the notice period constitutes acceptance of the updated Terms.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or use of the Service shall be subject to the exclusive jurisdiction of the South African courts.

14. General

• Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
• Entire Agreement: These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Offgrid Engineering (Pty) Ltd regarding the Service.
• No Waiver: Failure to enforce any provision does not constitute a waiver of the right to enforce it in the future.

1. Overview

GS Farm offers monthly subscription plans for livestock management software. This policy outlines when and how refunds are issued, and your rights as a subscriber under South African law.

2. Subscription Plans & Billing

All paid subscriptions are billed monthly in advance:

Payments are processed securely via PayFast. Your subscription renews automatically each month until cancelled.

3. Cancellation Policy

You may cancel your subscription at any time through Settings → Subscription Management in the app. Upon cancellation:

• Your subscription remains active until the end of the current billing period.
• No further charges will be made after that date.
• Your account will automatically downgrade to the free New Farm plan.
• No partial-month refunds are issued for unused time in the current billing period, as access to all paid features continues until the period ends.

4. Refund Eligibility

We do not offer refunds for the current billing period once a subscription is active and features have been accessed. However, a full refund of the most recent charge will be issued in the following circumstances:

• Billing errors: You were charged the wrong amount due to a system error.
• Duplicate charges: You were charged more than once for the same billing period.
• Service unavailability: GS Farm experienced a significant service outage exceeding 72 consecutive hours during a paid period.
• Cooling-off period: In accordance with the Consumer Protection Act, 2008 (Section 16), if you subscribed as a result of direct marketing — including through any of our authorised marketing partners — you have 5 business days from the date of subscription to cancel and receive a full refund, provided the service has not been materially used during that period.

Refund requests must be submitted within 30 days of the charge in question.

5. How to Request a Refund

Please include your account email address, the date and amount of the charge, and the reason for your request. We aim to respond within 3 business days and, where a refund is approved, process it within 7–10 business days back to your original payment method via PayFast.

6. Enterprise Subscriptions

Enterprise plan pricing and refund terms are governed by the individual contract signed at the time of onboarding. Please refer to your enterprise agreement or contact info@gsfarm.co.za for assistance.

7. Governing Law

This policy is governed by the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002.

1. What a Promo Code Offers

A valid GS Farm promotional code entitles the account holder to one free calendar month on any new paid subscription plan. The free month applies to the first billing cycle only; the subscription then automatically renews at the full monthly rate for the selected plan.

Promo codes are applicable to the following paid plans:

Promo codes do not apply to the free New Farm plan or Enterprise subscriptions.

2. Eligibility

• Promo codes are valid for new subscriptions only. They may not be applied to an existing active subscription or at the time of a plan upgrade.
• One promo code per account and per organisation. Each code may only be redeemed once.
• The account holder must be a new paying subscriber — accounts that have previously held a paid subscription are not eligible.

3. Redemption

• Enter your promo code on the subscription plans page before completing checkout.
• Codes must be entered prior to initiating payment. Codes cannot be applied retroactively to a completed transaction.
• If a code is valid, a "First month is FREE" confirmation will appear on screen before you proceed to PayFast.
• Codes are not case-sensitive.

4. Partner-Issued Codes

GS Farm works with authorised marketing partners who may distribute promo codes through their own channels (email campaigns, events, affiliate programmes, etc.). Partner-issued codes carry the same benefits and are subject to the same terms as codes issued directly by GS Farm.

GS Farm is not responsible for any additional representations made by a third-party partner beyond what is stated here. If you received a code from a partner and it does not work, contact us at info@gsfarm.co.za with the code and the name of the partner who issued it.

5. Expiry

• Each promotional code has an individual expiry date. Expired codes will not be accepted at checkout.
• GS Farm may withdraw or expire a code at any time without notice if it suspects misuse or unauthorised distribution.

6. General Conditions

• Promo codes have no cash value and cannot be exchanged for a monetary refund.
• Codes are non-transferable and may not be sold, auctioned, or publicly shared without prior written approval from GS Farm.
• If a subscription obtained via a promo code is cancelled during the free first month, the free benefit is forfeited and is not reinstated on a subsequent subscription.
• GS Farm reserves the right to cancel or reverse a subscription obtained through fraudulent or unauthorised use of a promo code.
• These terms apply in addition to GS Farm's Refund Policy and Terms of Service.
